I returned to the state court in another PCRA petition on November 27th, 2001 with the “newly discovered evidence” (Lawrence’s statement). The court stated I had 60 days from the day of discovery to file it in this court, and denied the petition February 12th, 2002. Lacking the knowledge of this law, being a layman, I am denied access to the Court. I appealed to the Superior Court, Commonwealth v. O’Neill 816 A.2d 332, denied October 28th, 2002. The Pennsylvania Supreme Court denied allocatur March 28th, 2003, Commonwealth v. O’Neill 820 A.2d 704 (Pa 2003). 
      I’ve faced roadblocks repeatedly. The Courts have whipsawed me back and forth between the State and Federal Courts with no hope of obtaining justice. Each time my access to the Court has become more limited. The court now refuses to address the case or newly discovered evidence which exposes corruption and a miscarriage of justice stating I am time-barred from justice due to new anti-terrorism laws since enacted. It’s hard to believe that the war on terror stops justice from being served, even when you’re innocent! “Due process of Law”, “Equal Protection”, “Access to the Courts”, all of which are supposed to be guaranteed by the United States Constitution. Our justice system has slipped off the foundation our founding fathers placed under it. All State Court Opinions in this care are Per Curiam – non published. 

      I ask for your help, letters of support to our State Representative, seeking new laws that would allow innocent people to have some type of corrective process available in the courts without a time frame on justice. 
     
Based on the facts presented herein, do you feel that I received a fair and impartial trial? If not, I urge you to write or e-mail Senator Greenleaf asking for a new investigation to be conducted into this case and his assistance in correcting this miscarriage of Justice. Your letters of support can be invaluable in providing me with the protection that the constitution promises all of us… and that I so long for and desire.

     a.       An investigation into this case.

     b.      Why an innocent person has no corrective process available to him by our Justice system?  That such should be established.

     c.       Request a new enacted law that will prevent time frames on our justice system to laymen.

    d.      Establish an innocent commission to help the innocent in prison and/or investigate their case.
